Introduction
These Terms and Conditions (“Terms”) govern your use of the ColorMyPic mobile application (“the App”), operated by Paweł Nawrocki UKD (“we,” “us,” or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
The App is intended for use by individuals aged 18 years or older.
1. Description of Service
ColorMyPic utilizes artificial intelligence (AI) to transform user-uploaded photographs into customized, printable coloring pages. Users can apply specific themes to alter the generated artwork.
We reserve the right to modify, update, or discontinue any part of the App or its features at any time.
2. User Accounts
To use the App, you must register an account using a valid email address and a One-Time Password (OTP).
- Account Requirement: An account is required to use the App. You are responsible for maintaining the confidentiality of your account access.
- Account Deletion: You may request deletion of your account at any time by contacting us. Upon deletion, your access to the App will be terminated and any remaining credits may be forfeited.
- Suspension and Termination: We reserve the right to suspend or terminate your account if you violate these Terms (e.g., attempting to bypass safety filters, abusing credits, or using automated means). In such cases, any remaining credits may be forfeited without refund.
3. The Credit System
The generation of coloring pages requires “Credits”.
- Credit Deduction: A credit is deducted when you request delivery (download) of a generated coloring page from our servers. Generation alone does not consume a credit. We are not responsible for incomplete or failed downloads caused by user connectivity, device issues, or factors outside our control.
- Welcome Credits: New accounts may receive introductory credits. These are limited to one per user/device and may be revoked in case of abuse.
- Allowance Credits: Provided as part of a free trial or subscription. These reset periodically and do not roll over unless explicitly stated.
- Purchased Credits: Bought via one-off purchases. These do not expire and are consumed after Allowance Credits.
We reserve the right to adjust the credit system, including pricing, allocation, and expiration rules.
4. Payments, Subscriptions, and Refunds
- In-App Purchases: All purchases are processed through the Apple App Store or Google Play Store.
- Subscriptions: Subscriptions renew automatically unless canceled via your app store account settings. Cancellation applies to the next billing cycle.
- EU Right of Withdrawal: By purchasing digital content (including credits), you expressly consent to the immediate performance of the service and acknowledge that you lose your statutory right of withdrawal once the service has begun.
- Refunds: Except where required by applicable law, purchases are non-refundable due to the consumable nature of digital credits.
5. User Content and Acceptable Use
- Your Photos: You retain ownership of the photographs you upload (“User Content”). You grant us a limited, temporary license to process this content solely to provide the service.
- Generated Content: You may use generated images for personal, non-commercial purposes. We do not guarantee uniqueness or exclusivity of outputs.
- User Responsibility: You represent and warrant that you have all necessary rights, permissions, and legal authority to upload and use any content submitted to the App, including explicit consent from any individuals depicted in the images.
- Prohibited Content: You agree not to upload content that is illegal, infringing, harmful, or violates the rights of others.
- Safety Filters: We may reject or block content based on automated safety systems.
- Abuse and Misuse: You agree not to:
- Use automated systems (bots) to access the App
- Create multiple accounts to exploit free credits
- Attempt to bypass safeguards or exploit system behavior
6. Strict Prohibition of Commercial Use
ColorMyPic is intended strictly for personal, family, and non-commercial use.
- You may print and share outputs for personal use.
- You may not sell, license, distribute, or commercially exploit generated content.
- Note for Educational/Institutional Use: If the App is used within a school or kindergarten setting, the individual operating the App assumes complete legal responsibility for securing explicit, documented consent from the parents/guardians of any minors before uploading their photos.
7. Third-Party Services
The App relies on third-party service providers (including cloud infrastructure, AI processing, and payment platforms). We are not responsible for interruptions, errors, or data processing performed by these services beyond our control.
8. Limitation of Liability
- AI Limitations: Because the App utilizes generative AI technology, the output is generated dynamically. While we strive for high-quality and safe results, we do not guarantee that every output will perfectly resemble the input photo or meet your subjective expectations.
- Service Availability: The App is provided “AS IS” and “AS AVAILABLE”. We are not liable for any temporary server downtimes, data loss, or failed generations.
- Liability Limitation: To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages resulting from your use of the App.
Nothing in these Terms excludes or limits liability for:
- gross negligence,
- willful misconduct,
- or any rights that cannot be excluded under applicable consumer law.
9. Privacy Policy

10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the App constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Poland, without regard to conflict of law principles.
